Regulatory consultation is usually treated as something that happens to fleets rather than something they participate in. The heavy-vehicle AEB rulemaking is an unusually good case for the opposite view.
Where the rule stands
NHTSA and FMCSA proposed mandating automatic emergency braking and electronic stability control on new Class 7 and Class 8 trucks. Originally expected to be final in early 2025, it is now scheduled for reissue as a supplemental proposed rule, allowing additional analysis and public comment before adoption.
The proposal would apply from 2027 for Class 7 and 8, with medium-duty following in 2028, covering speeds from roughly 6 mph to about 50 mph.
NHTSA estimates it would prevent 19,118 crashes, save 155 lives and prevent 8,814 injuries annually.
Why a supplemental proposal matters
Reissuing as a supplemental proposal reopens the record. That is not a delay to endure — it is a second opportunity to put evidence in front of the agency before the text is fixed.
And the agency is short of exactly the evidence fleets hold.
What operational data is worth submitting
False activation rates and circumstances. Roadside furniture, tight urban turns, spray from adjacent vehicles. This determines whether a performance standard is workable in real operation or only on a test track.
Sensor performance in poor weather. Snow, heavy rain, road salt, low winter sun. A system specified without accounting for these behaves differently in January than in the test data.
Maintenance burden. Calibration requirements, cost, and downtime. A windscreen replacement on a sensor-equipped vehicle is no longer a glass job, and that has a real operational cost.
Driver interaction. How drivers respond when a system intervenes, and what training proved necessary.
Why this is not merely civic
The provisions most likely to change between proposal and final text are the ones where the record is thin. Fleets that submit specific, documented operational experience are shaping the standard they will operate under for a decade.
The alternative is a standard written from test-track data and modelling, which fleets then live with.
Meanwhile
Many manufacturers already fit AEB as standard or optional equipment. The regulation would set a floor and standardise performance rather than introduce the technology.
Treating it as an operational decision rather than a compliance one is the practical position: if the technology prevents a fraction of the projected crashes, the business case does not depend on the timeline.
